Zara is 26 and in love. Her family does not approve. Someone told her she can walk into a court, sign a paper, and be married. Another person told her that kind of marriage is a sin and has no value in Islam. Both can't be right. So what is the truth?
The truth is simpler than the gossip. A court marriage in Pakistan is a normal nikah, done quietly and registered properly. It is not a separate kind of marriage. The court is not the one that marries you. The Nikah is performed under Islamic rules, and then the registration is done through the law. If the Islamic conditions are met, the marriage is valid in Islam. The registration makes it valid in the eyes of the state.
What is a court marriage in Pakistan?
A court marriage is the name people use for a marriage where the couple skips the big ceremony. A lawyer often helps. The Nikah Nama is signed. Witnesses are present. The marriage is then registered with the Nikah Registrar and the Union Council.
This is not a marriage done inside a courtroom by a judge. For Muslims, the nikah takes place according to Islamic rules. First comes the offer and acceptance (ijab o qubool), then the witnesses, then the haq mehr (the dower). The legal paperwork completes it. Nothing about this conflicts with Islam.
What makes a marriage valid in Islam?
Under Muslim law in Pakistan, a marriage is valid when these elements are present:
- Ijab o qubool, the offer by one party and acceptance by the other, said in front of witnesses.
- Witnesses. Usually at least two male witnesses, or one male and two female witnesses.
- Haq mehr, a dower that is agreed and written in the Nikah Nama.
- Wali, the consent of the bride's guardian where it is required under her school of thought.
- Both parties are of sound mind and consent freely.
These are the same conditions for any nikah. A court marriage does not remove them. It simply records that they were fulfilled. So when a family says a court marriage is not valid in Islam, that claim does not hold. What makes a marriage valid is the nikah with its conditions, not where the ceremony was held.
Is a court marriage valid in Islam?
Yes. A court marriage is valid in Islam when it is done as a proper nikah. The registration under the law does not make it un-Islamic. It does the opposite. It protects the marriage and the rights of both spouses.
The Muslim Family Laws Ordinance 1961 is the law that governs this in Pakistan. Section 5 of that law says every Muslim marriage must be registered. The full text of the Ordinance is available from the Government of Punjab. Under Section 5(3), failing to register a marriage is an offence that can carry a fine and even a short jail term. So registration is not optional. It is the law.
A marriage that avoids the ceremony but meets the Islamic conditions and is registered is fully valid. It is as valid as any big nikah with hundreds of guests. The difference is only the celebration, not the marriage itself.
Why do people choose a court marriage?
Couples usually choose a court marriage when the family opposes the match. It is also used when the two families come from different sects, when one spouse has been married before, or when the couple simply wants the legal paperwork done cleanly from the start.
For women especially, a registered marriage matters. A registered Nikah Nama is the evidence a woman needs in a family court. Without it, she cannot easily claim maintenance or prove the marriage exists. Registration protects her far more than a grand ceremony does.
Can a woman marry without the permission of her guardian?
This is where the schools of thought differ. Under Hanafi fiqh, which most people in Pakistan follow, the consent of a male guardian (the wali) is normally required for a woman's first marriage. Under other schools, an adult woman can contract her own marriage.
In practice, courts in Pakistan have taken the view that when a marriage is free of coercion, both spouses are adults, and the Islamic conditions are met, the marriage is valid. A father or guardian cannot force a child into a marriage either. Forced marriage is not valid.
Separation from this, the key point is consent. A nikah done by free agreement of both adults, with witnesses and mehr, is valid. This is consistent with the rules on marriage rules in Pakistan that we have covered before.
How is a court marriage registered?
The steps are straightforward:
- Complete the Nikah Nama with the Nikah Registrar. It is signed by the couple, the witnesses, the wali where required, and the registrar.
- The registrar sends a copy of the Nikah Nama to the Union Council within seven days.
- The Union Council enters the marriage in its register and issues the registration record.
- After that, you can get a computerised NADRA marriage certificate.

What documents do you need?
- CNIC of both spouses.
- CNIC of at least two witnesses.
- CNIC of the wali, where his consent is required.
- Passport size photos of both spouses.
- Divorce decree or death certificate if either spouse was married before.
- Proof that both are of legal age.
The minimum legal age for marriage in Pakistan is 16 for women and 18 for men under the Child Marriage Restraint Act 1929, as amended. Marrying below those ages is a criminal offence in Pakistan.
What rights does a registered marriage protect?
Once the marriage is registered, both spouses are protected by law. The wife can claim maintenance. Both inherit from each other. Children born of the marriage are legitimate. The marriage is provable in a family court if a dispute ever arises.
NADRA and the Union Council hold the official records. Keeping your marriage registered is one of the simplest legal steps you can take to protect your family.
