Can you marry for love in Pakistan?
Short answer: yes, if you are both adults and you both agree freely. The law does not ask for anyone's permission once you are grown up and of sound mind. This is one of those areas where what people assume and what the law says are not the same thing. Let me walk you through it.
What makes a valid nikah?
In Islam, marriage is a contract. It is not a sacrament the way it works in some other religions. A valid nikah needs a few things: an offer (ijab) and an acceptance (qubool) made in the same meeting, two witnesses, and a stated dower (haq mehr). That is it.
This point is settled in case law. In Abdul Kadir v. Salima, the court held that marriage among Muslims is a civil contract, not a sacrament. So the whole question turns on whether both people agreed. Consent is the heart of it.
Does a girl need her wali's permission?
Here is where opinions split. Under the Shafi'i school, a marriage without the guardian's (wali's) consent is not valid. The Maliki school only needs the wali for a first marriage.
But Pakistan mostly follows the Hanafi school. Under Hanafi law, an adult woman of sound mind can contract her own marriage without the wali's consent. The wali is not a legal requirement for a grown woman.
You can see this in the courts. In Abdul Waheed v. Asma Jehangir, the famous Saima Waheed case, the Supreme Court ruled that an adult woman can marry of her own free will. The same view appears in Muhammad Shawal v. Sonia Farooq, where a mature Muslim woman married someone of her own choice without her guardian's consent, and the court upheld it as valid. Does your age matter?
Yes, and this is the line you need to watch. The right to choose your own spouse belongs to an adult of sound mind. A child marriage is a different thing and the law treats it differently.
The age limit is not uniform across the country. Under the federal Child Marriage Restraint Act 1929, the age was 18 for boys and 16 for girls. The provinces have moved on since then. Sindh passed the Sindh Child Marriage Restraint Act 2013, which fixed the minimum at 18 for both sexes. Punjab passed a Child Marriage Restraint Bill in 2026 setting 18 as the minimum age for girls. So check the age in your own province.
If one side is below that age, guardianship and permission still matter, and the marriage can be challenged. As an adult, your choice is yours.
Is a court marriage the same thing?
Almost. A court marriage is just a nikah done before a magistrate or a licensed nikah registrar, without a big ceremony. It needs the same things: offer, acceptance, witnesses, and dower. The step that matters: registration
Whatever you decide, get the nikah registered. Under Section 5 of the Muslim Family Laws Ordinance 1961, every Muslim marriage in Pakistan must be registered with the Union Council. The nikah registrar must fill the nikahnama and send a copy to the Union Council within seven days.
Registering gives you a paper trail. It is what you need later for a NADRA certificate, for passports, for visas, and for claiming rights like maintenance and inheritance. Without it, a lot of doors stay shut, even when the marriage is valid in religious terms.
Here is what a properly registered nikah gets you:
- A copy of the nikahnama for both spouses
- A Union Council registration record
- A NADRA computerised marriage certificate on top of that, which makes the marriage easy to prove
What if your family objects?
The law is on the side of two consenting adults. If you are both of legal age and you married freely, a family objection does not make the nikah invalid. Pakistani courts have protected marriages of choice, including by ordering police protection where there was a genuine threat.
What usually bites is not the family's objection but the paperwork. If the nikah was never registered, proving the marriage becomes your problem. Register it, keep the nikahnama safe, and get the NADRA certificate. That is the practical advice a lawyer would give you.
