Is free legal aid a right in Pakistan?
You are in a police station, or you got a court summons you cannot understand, and the lawyer you met wants a fee you do not have. What does the law say?
Start with the Constitution. Article 10 gives every arrested person the right to be told why they are held and the right to consult and be defended by a lawyer of their choice. Article 10A makes a fair trial a fundamental right. The Supreme Court has called access to justice an inviolable right under Article 9, in Sh. Riaz-ul-Haq v. Federation of Pakistan, PLD 2013 SC 501.
A right to a lawyer is not the same as a free lawyer. But the law moves in that direction. Section 340 of the Code of Criminal Procedure 1898 says any person accused of an offence may of right be defended by a pleader. A pleader is what the law calls a lawyer. For children the law is clearer. Section 3 of the Juvenile Justice System Act 2018 says every juvenile, and every child victim of an offence, has the right to legal assistance at the expense of the State.
Who can get free legal aid?
Legal aid is not for everyone. It is for people who cannot afford a lawyer.
The main federal body is the Legal Aid and Justice Authority, or LAJA, set up under the Legal Aid and Justice Authority Act 2020. It helps the poor and vulnerable, especially women and juveniles, in criminal cases, with preference for women and children in sexual offence cases.
Where to get free legal aid in Pakistan
1. The Legal Aid and Justice Authority. This is the federal route. Apply online at the official LAJA website, or call 051-9201790. The form asks for your monthly income, your case type and your category: woman, child, person with disability, indigent person, or other. District level services began in 2026 from Rawalpindi and Islamabad.
2. Bar Council legal aid committees. The Legal Practitioners and Bar Councils Act 1973 gives the Pakistan Bar Council the duty to provide free legal aid. Under the Pakistan Bar Council Free Legal Aid Rules 1999, committees work at three levels: national, provincial and district. The national committee handles Supreme Court cases, provincial committees the High Courts, and district committees the district courts. Each keeps a panel of lawyers who work free or at reduced fees for people entitled to Zakat or unable to bear the cost of a lawyer.
3. The District Legal Empowerment Committee. In 2011 the Law and Justice Commission of Pakistan made rules for committees known as DLECs. The District and Sessions Judge heads it, with the District Coordination Officer, the District Bar Association president and the jail superintendent as members. It helps litigants who cannot afford lawyer, court or process fees. More than 106 DLECs have been set up in the four provinces. See the Law and Justice Commission page on DLECs.
4. The Punjab Legal Aid Agency. Established in 2019 under the Punjab Legal Aid Act 2018, it helps indigent accused persons and women in family disputes such as divorce, maintenance, dowry, dower and custody of children. It works under the Public Prosecution Department.
5. For civil cases: sue as a pauper. If your problem is civil, like a property or money dispute, and you cannot pay the court fee, Order 33 of the Code of Civil Procedure 1908 lets you ask the court to sue as a pauper, meaning a person who cannot pay the fee. The court checks your means, and if satisfied, your case runs without court fees.
6. Legal aid organisations. Non government bodies help too. The Legal Aid Society in Sindh runs a 24/7 free helpline at 0800-70806. The Asma Jahangir Legal Aid Cell and the Human Rights Commission of Pakistan also assist.
How to apply for free legal aid step by step
Step 1: Check whether you qualify. Check the LAJA website criteria or call 051-9201790.
Step 2: Fill the application form. Go to laja.gov.pk/application. You give your CNIC, monthly income, province, case type and a short description. You choose your category and get a reference number to track the application.
Step 3: Wait for contact. LAJA says it contacts applicants within 3 to 5 working days.
Step 4: Get your assigned lawyer. If your application is approved, a panel advocate is assigned within 7 working days and contacts you directly. You do not pay.
For the other routes, walk into the District Bar Association office and ask for the legal aid committee. The 1999 rules accept an application on a simple sheet of paper with an affidavit. For capital cases in the High Court, the Destitute Litigant Fund Rules 1974 give a court arranged lawyer to a destitute person charged with an offence punishable with death. Poverty is the only test.
What does free legal aid not cover?
Free legal aid is real, but it has limits. LAJA's focus is criminal cases, though its form also lists civil and family cases. The money is limited.
Availability varies by district.
Be honest in your application. A false declaration can lead to rejection and repayment.
What it means for you
If you are facing a case and cannot pay a lawyer, start with the doors above. Call LAJA on 051-9201790 or apply online. Walk into the District Bar Association office, or ask the court. The law says the door should not close because of money. Maternity leave is a paid right too, and these same doors open if your employer refuses it. See maternity leave in Pakistan for the weeks and pay.
Violence at home has its own law. See domestic violence law in Pakistan for protection orders and helplines.
Criminal cases usually begin with an FIR, and our guide to what an FIR is explains that first step.
